Terms And Conditions of Bake with Yen Membership Programme
1. Bake with Yen Membership Programme (hereinafter referred to as the “Programme”) are the proprietary right of BWY Holdings Sdn. Bhd. (1108277-W) (hereinafter referred to as “BWY”, “Company”) where the participation of any person(s) to the Programme shall be subject to the approval and acceptance by the Company. Once the participation is accepted by the Company, any such person (hereinafter referred to as the “Member”) in the Programme shall be subjected to the terms and conditions contained herein. The Membership Programme is only applicable and accepted in Malaysia.
2. In order to become a Member, the applicant must agree to the terms and conditions contained herein. The Company reserves the right to make amendments or variations to the terms and conditions from time to time without prior notice.
3. Participation in the BWY Membership Programme is open to all citizens and residents aged 18 years old and above.
4. Member will be rewarded with one (1) loyalty point for every transaction of RM1 (exclusive of tax). Member must spend a minimum of RM1 and above in a single transaction to be qualified for the programme.
5. Once the Membership Card is credited with the loyalty Points corresponding to the qualifying purchases, a transaction receipt will be issued to the Member at the checkout counter. Such transaction receipt shall be the final and conclusive evidence of the qualifying purchases made for the loyalty Points accumulated and will be reflected in the membership account within 24 hours after the transaction.
6. Purchases or Charges of the following items are not entitled for points rewarding:-
a. Price-controlled items as announced by the Authority from time to time (eg. flour, sugar, rice, oil, eggs etc.);
b. Gift card/cash vouchers purchase;
c. ePay services, i.e., mobile reload, IDD reload, online game reload, e-wallet reload, Touch ’n Go reload, epay upload, Utilities Bills Payment, Payment to Authorities, etc;
d. Delivery Charges, Repair & Service Charges;
e. Any purchase in conjunction with other promotions; and
f. Any other items the Company may revise from time to time.
7. The loyalty points awarded and credited to the Membership Card cannot be transferred or assigned to any other Membership Card holder or any other card issued by or on behalf of the Company. No combined or aggregated loyalty points of such Membership Card or otherwise dealt with unless expressly stated by the Company. The loyalty points cannot be exchanged for cash.
8. Member must present their BWY eCard or phone number or Membership number at cashier before checking out for every transaction. No point will be awarded for the purchase if Member fails to present the card prior to check out.
9. Points accumulated will expire in the event that member does not make any qualifying purchase and earn any points within the period of six (6) months from the date the last points were awarded. In such event, the B2B membership tier will be revised.
10. For B2C membership, points accumulated will expire in three (3) years from the date the last points were awarded.
11. The Company gives no representation or warranty with respect to any products and/or services featured in the Rewards catalogue. Where the Rewards are covered under any manufacturers' warranty, any disputes or claims shall be referred directly to the manufacturers concerned.
12. Member must present his/her Membership Card and National Identity Card (NRIC) if he/she is redeeming Rewards from the participating merchants or participating suppliers of Rewards appointed by the Company from time to time.
13. Member who has redeemed his/her points for any BWY rewards, i.e., merchant products or services, is not eligible for refund or cancellation from the Company.
14. Member is responsible to examine and verify the Rewards immediately upon receipt. If the Rewards (whether its content or packaging is found to be damaged, defective, or incomplete), member must immediately inform the Customer Service at the check-out counter and return the Rewards on the spot for replacement.
15. It is the Members’ responsibility to notify the BWY management of any changes of his/her personal particulars, lost or damaged card.
16. To participate in this Programme, the Member agrees that their Personal Data may be used by Company for the purposes below: -
a. To associate the Card to the Member and to update information (if required);
b. To process the application by the Member for any related services;
c. For the management, operation and maintenance of the Member's account and system including but not limited to audit and exercising the rights of the Company under the terms and conditions;
d. Designing new products or improving existing services provided by Company, our subsidiaries, associates and affiliates;
e. For communication by the Company to the Member;
f. For investigation of complaints, suspected suspicious transaction and research for service improvement;
g. Prevention or detection of crime or fraud; and/or
h. Disclosure as required by law, rules, regulations, codes or guidelines.

17. Members are deemed to have subscribed to the marketing mailing list upon registered as a “Member” in the App and the Company will send or deliver the marketing information and relevant updates (“Newsletter(s)”) via push notification, SMS, electronic direct mail (e-DM) and/or direct mail (DM).
18. The Member may terminate his/her membership at anytime by giving written notice to the Company. However, there will be no refund of points collected in any form for termination of membership.
19. Any abuse or fraud with respect to the points under the Programme or Rewards redemption will result in the cancellation of the Member's participation in the Programme, the Membership Card and revocation of the Points. The Company also reserve the right to claim for any redeemed Rewards (or its reasonable compensation thereto).
20. The Company reserves the right to restrict, suspend, or change any features and benefits of the membership programme, including the terms and conditions from time to time without prior notice or assigning any reasons.
21. The Company shall not be liable for any losses of the accumulated points or damages suffered as a result of any defect or error in any machines/system or the Company’s inability to retrieve any information or data from the computer system.
22. The Company shall not be liable howsoever for any errors, delays, loss or damage, which may be directly or indirectly due to breakdown, failure of machinery or the processor; or any force majeure events, including but not limited to, industry dispute, war, act of God, pandemic, epidemic, system failure and/or any other events which are beyond the Company’s control.
23. The Company shall not be liable for any losses, expenses or damages suffered by the Member as a result of: -
a. any failure of the participating suppliers/merchants to abide with the terms and conditions it has agreed to;
b. any statement, communication or implication arising from any revocation, suspension or restriction for the use of the Card; and
c. any failure or omission of the Company to notify the Member of any changes in the terms and conditions contained herein, Rewards guide, participating merchants, qualifying purchases and/or the Points awarded for qualifying purchases.

We are committed to safeguarding your privacy and ensuring that your personal data is protected. We therefore make sure that our policies and practices in relation to personal data comply with the requirements of the Personal Data Protection Act 2010 (“PDPA”) under the laws of Malaysia.

We are one of the largest baking ingredients retail stores in Malaysia specialising in manufacturing, supplying, distributing and retailing baking ingredients, premixes, baking accessories and tools. We offer a one stop solution for all your baking needs.
2. When and What data do we collect?
We may collect your personal information such as your name, address, email address, personal identification number, date of birth, phone number, banks, e-wallets or credit/debit cards details and/or any other personal information while you are: -
shopping with us (whether physically or online);
browsing our website;
registering an account with us;
signing up for our email marketing, newsletter or updates;
submitting an inquiry form;
participating our internal activities, internal market surveys and trend analysis; or such other purposes as may be related to the foregoing.

If you are our business customer, we will also ask for your company registration number, Sales and Service Tax (SST) identification number and other related company information.
3. How do we use your data?
We use your personal information to process order and payment. It allows us to check and update the status of your order. We also use it to send you an invoice, if applicable. Without it, we cannot deliver the baking ingredients you purchase to your home address or at your selected pick-up BWY stores. We also use it to contact you if, for example, we need to check something about your order (eg. delivery or other details).
We would like to get to know you more, so that we can provide you with personalised experience while you are shopping with us, suggest recommendations for your order that suit your preference, process, manage or administer your application in relation to our customer loyalty membership programme. We keep and maintain your contact details and order history in our system especially when you register an account with BWY or sign up for our marketing newsletter. And if you take part in any of our campaigns, survey or submit an inquiry, we make a note of that too, together with details of any interactions we have with you. These can help us to see what products you like, how often you shop with us, what your interests are and to seek feedback in relation to your customer service experience with us. We use this information to let you know how you’re making a difference in our business. We also use it to keep improving and updating our website, our product range, to develop campaigns and tell you about things you’re interested in.
